After the Prosecution counsel, Mr. K. E. Kaswe, withdrew the charge, Trial Justice Binta Nyako dismissed it.
Kaswe, from the Federal Ministry of Justice, withdrew the charge after Kanu's legal team, led by Chief Mike Ozekhome, SAN, accused the FG of deliberately delaying the case's resolution.
Ozekhome noted that the amended charge was served on him only 48 hours before the court date.
He claimed that FG added new issues to the amended charge, such as additional documents and proof of evidence that were not previously attached to the case.
"My lord, pictures of lawyers waiting for a meeting with the defendant at the DSS facility were taken with a secret camera and displayed in one of the attachments."
His lawyers, Ifeanyi Ejiofor and Maxwell Opara, were also named. They have introduced new issues and even changed the charge's wording. The fact that the court upheld only seven counts in the previous charge and has now reduced it to six counts indicates that the charge has already been altered," Ozekhome argued.
As a result, he argued that the Prosecution was wrong to insist on proceeding with the trial without first rearraigning the defendant.
Because of Ozekhome's contention, FG's lawyer, Kaswe, filed an application to withdraw the amended charge, allowing the case to proceed to trial.
Kaswe informed the court that his first witness was ready to testify.
As a result, Justice Nyako dismissed the charge.
